T E M N Z A  Sports News (“we,” “our,” or “us”) respects the intellectual property rights of others. We expect users of our website, temnza.com, and any other media form, media channel, mobile website, or mobile application related or connected thereto (collectively, the “Site”) to do the same. In accordance with the Digital Millennium Copyright Act (DMCA) of 1998, we have implemented procedures for receiving written notification of claimed copyright infringements and for processing such claims in compliance with the DMCA.

1. Notification of Infringement Claims

If you believe that your copyrighted work has been copied or used on the Site in a way that constitutes copyright infringement, please provide our Designated Copyright Agent with a written notice that includes the following information:

  • A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright that is allegedly infringed;
  • Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site;

  • Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an email address at which you may be contacted;
  • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;
  • A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Please be aware that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability.

2. Counter-Notification

If you believe that your material that was removed (or to which access was disabled) is not infringing, or if you have authorization from the copyright owner, the copyright owner’s agent, or pursuant to the law to post and use the content in your material, you may send a counter-notification to our Designated Copyright Agent. Your counter-notification must include:

  • Your physical or electronic signature;
  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled;
  • A statement that you have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification of the material; and
  • Your name, address, telephone number, and email address, a statement that you consent to the jurisdiction of the federal court in [your judicial district], and a statement that you will accept service of process from the person who provided notification of the alleged infringement.

Upon receipt of a valid counter-notification, we will forward it to the party who submitted the original claim of copyright infringement. If the original claimant does not file a lawsuit against you within 10 business days of receiving the counter-notification, we may restore the removed material.

3. Repeat Infringer Policy

T E M N Z A Sports News reserves the right to terminate user accounts or deny access to the Site for users who are determined to be repeat infringers.

4. Modifications to This DMCA Notice

We reserve the right to modify this DMCA notice at any time. Any changes will be effective immediately upon posting on the Site, and your continued use of the Site following the posting of any changes constitutes your acceptance of such changes.
